Terms And Conditions Of Medilab Estetik Services Agreement
The Terms and Conditions (T&C) in this Agreement govern your relationship with London Assistance Limited registered at Kalamu House 11 Coldbath Square London EC1R 5HL (Companies House Registration Number: 10007507), engaged in the business of facilitating or referring medical tourism and medical procedures services marketing by offering such services under the registered trademark of Medilab Estetik. Accordingly, London Assistance Limited and Medilab Estetik are used interchangeably. The T&C apply to all Medilab Estetik medical procedure packages you determine and accept. By accepting the T&C in this Agreement, you understand and are legally bound by them and therefore, please peruse and acknowledge them carefully.
Acknowledgement and Acceptance of the Terms and Conditions
Medilab Estetik services offered on this website is conditioned upon your acceptance, without modification and your use of the https://www.medilabestetik.com website establishes the acknowledgement and agreement with such terms. Medilab Estetik reserves the right, at its sole discretion, to change, modify, add or remove temporarily or permanently of these terms and conditions. Medilab Estetik shall not be liable to any user or third party for any such modification, suspension or discontinuance.

Medical Tourism Facilitation Services: Include internet marketing, research, placement, payment coordination, facilitation of medical records transfers, provider/patient liaison, travel arrangement services such as ground transfers, in-country transportation and hotel accommodations, translator services, recovery and after care facilitation, monitoring, and medical case management services.

Medical Procedure Plan: A document outlining the particulars of the specific Medical Procedure Package you intend to purchase.

Medical Procedure: The healthcare service, medical procedure or surgery you have chosen to undertake.

Medical Procedure Package: The combination of medical procedure, surgery, accommodation, private transfers, host and pre-operative tests (if required) you have chosen to purchase from Medilab Estetik.

Medical Procedure Provider: The hospital, private clinic, surgeon or any other medical professional providing your consultation, examination, medical procedure and care and aftercare.

Destination: The place (the country and/or city) to which you will be travelling for your medical treatment, basically in Turkey.
1. Medical Procedure
Limitation of Liability: Medilab Estetik is not a treating physician, any other medical provider or does not provide medical advice nor does perform any surgery or medical procedure or control any Medical Procedure Provider facility or service rendered by them but rather acts only in the capacity of facilitator and coordinator. Information provided by Medilab Estetik is based on the best publicly available information and is not intended in any way to be used as a substitute for advice from a patient’s physician. Your treatment forms and prompts a contractual relationship between you and the Medical Procedure Provider providing the medical procedure and treatment. We do not hold medical qualifications and shall not be held responsible or liable for any medical procedures provided through your chosen Medical Procedure Provider. Nor shall be held responsible or liable for any care, treatment or other services you are provided with by the same, or for any malpractice claims that may arise directly or indirectly from their advice. Similarly, we shall not take any responsibility or liability for the complications and dissatisfactions arising from Medical Procedure Provider’s treatments. You acknowledge that you have conducted the necessary due diligence with respect to the risks involved in the medical procedure you choose and have decided to seek treatment with no influence or pressure from Medilab Estetik. Our role is solely to facilitate and coordinate a consultation between you and your Medical Procedure Provider. We strongly recommend that you carefully read and put reliance to Medical Procedure Provider’s terms and conditions and medical procedure “Patient Consent Form”, which is not described herein as proprietary, prior to proceeding with your treatment. In addition, be aware that Medilab Estetik offers no insurance, guarantee or warranty in any respect related to services delivered or rendered by Medical Procedure Provider.
The treatment plans offered by Medilab Estetik as a result of email exchanges, telephone conversations or video consultations are purely based on the information (i.e. the pictures, videos, medical images, test results, prescriptions, etc) provided by you and reviewed by the Medical Procedure Provider. Therefore, your treatment plan may change when the Medical Procedure Provider and respective doctor to undertake the procedure examines you in person before your medical procedure. You have an option to reconsider your position and do not undertake the procedure if such a change arise. In such circumstances, you will receive a refund after pro rata deductions for operational services for your specific procedure, consultations, tests and examines by your designated doctor. Please be advised that we are not in a position to reimburse operational costs such as travel, transfer and accommodation due to using third party providers to make such arrangements as we do not directly operate and control these providers.
Upon your examination and consultation leading into a new Medical Procedure, we will quote you the revised price if you agree to go with it. Accordingly, the advance payment, additional costs and the remainder balance of the total price will be adjusted, based on the initial payments to be made or already made. Based on the change and duration of stay, the additional operational costs for further travel and accommodation etc. will be factored in the price adjustment. Medilab Estetik takes no responsibility for new circumstances and cannot be held liable for the disorder and disarrangement of such additional operational costs.
By acknowledging and accepting these T&C, you agree not to hold Medilab Estetik responsible for medical complications, medical negligence or malpractice by your chosen Medical Procedure Provider.
Non-Disparagement: By accepting these Terms and Conditions, you agree not to offence or negatively criticise publicly Medilab Estetik, its directors or any of its employee, associate or business partner in physical or virtual meetings or platforms such as websites, social media networks, blogs, public forums etc., in regards to Medical Procedure Provider’s procedures and actions. As Medilab Estetik cannot be held responsible for the services, medical procedures and treatments provided by the Medical Procedure Provider, you agree not to associate bad reputation to Medilab Estetik, its directors or any of its employees or initiate any action that negatively affects Medilab Estetik, its reputation or services at any time during or subsequent to contract period.
In case we evaluate with factual corroboration that this clause has been breached by you, you agree to withdraw and unload the negative content without any delay. If content not withdrawn or unloaded, in part or in whole, you agree to pay £4,000 to Medilab Estetik to compensate any harm.
2. Medilab Estetik’s Responsibilities
As part of this contract, we will provide you with a Medical Procedure Plan and travel and operational arrangements in advance of your journey, not limited to but containing the following information:
a) Information about your medical procedure package;
b) Information about the costs of your medical procedure package;
c) Information about visa and passport requirements (this information can also be obtained from https://www.evisa.gov.tr/en/);
d) Information about health formalities required for the journey and the stay;
e) Date, timing, places of intermediate stops and transport connections.
f) The name, address and telephone number of your Medical Procedure Provider or of an agency in that locality on whose assistance you can call.
We do not operate or control the services offered by the Medical Procedure Provider or hotel, travel or transfer companies. By accepting this Agreement, you agree that as Medilab Estetik we cannot provide any warranties in using any services of third party providers. In no condition, we would be held liable for any damages for you using third party healthcare, accommodation, travel or transfer providers we refer to.
We recommend you to obtain and peruse all terms and conditions of the third party providers prior to acquiring booking from us.
We will duly get in touch with you if we have to amend or cancel your booking. In such event, you rightfully have an option to reorganize your medical procedure with us or cancel your booking and get a refund calculated on a scale. However, we cannot be held responsible for any damages or expenses you suffer for the conditions beyond our control. From time to time, events often arise or do not proceed as planned-and may suggest that some room for flexibility and modification of plans be built into arrangements by Medilab Estetik. Circumstances beyond our control or force majeure include the following:
a) Epidemic circumstances;
b) Flight delays or cancellations;
c) Civil unrest, strike, terrorist activity;
d) War;
e) Severe natural disasters such as earthquake, hurricane, flooding etc.
The Medical Procedure Plan we will provide to you containing the above information will form part of this contract and should be read in conjunction with it.
3. Your Responsibilities
Your due diligence of our literature: You will duly study the literature made available to you, including information contained on our website in connection with matters set out at Article 2 above, before you accept this agreement. By accepting this agreement you acknowledge and agree that you have read and understood the information made available to you, full responsibility of your own safety and expressly assume all risks of harm, whether foreseen or unforeseen, and whether occurring while travelling, during pre/post-operative care, during the desired procedure, at any time.
Travel information, passports, visas and documentation: You are responsible for ensuring you have the following:
a) A valid, acceptable passport.
b) A visa, if necessary.
c) Other travel documentation.
It is your responsibility to provide to provide, in advance of travel, passenger information or locator form to your airline or officials. You must also meet the entry requirements for both your final Destination and any intermediate stopover points en-route. Medilab Estetik assumes no responsibility if you miss your flight, including your connections. You are responsible for providing all necessary official documents and forms, including passport and visa.
You accept and agree that in the event of your failure to fulfill the requirements enumerated in above paragraphs, or the information or documents provided by you being incorrect or misleading, you may well be denied to board and refused to enter to the country you are visiting. You accept and acknowledge that in the event of such incidence you will be solely accountable for all consequential costs and Medilab Estetik will accept no responsibility or liability thereof.
The sole responsibility lies with you for any fines or costs (including the costs of an immediate return flight) you incur due to your failure to travel with the passport, visa or other official documentation required for travel and entry. Medilab Estetik accepts no liability if you end up in failing as such and no compensation, expenses, refund or other reimbursement will be paid.
Health precautions: You will get health advice about your specific needs, or required or recommended vaccinations if any well in advance of travel. This information can be obtained from, among others, the following websites:

You should also seek advice from your local GP.
Insurance: The responsibility of the travel and any complications, if arise any, from the travel lies with you and so is an insurance covering any risks of such complications to indemnify you for any losses from travel and medical problems. We offer no insurance, guarantee or warranty in any respect related to products or services delivered or rendered by third parties. It is a condition of your purchasing a Treatment Package from us that you take out insurance with an approved insurer. Your acceptance of these T&C constitutes acceptance of this obligation.
4. Costs & Payment
Depending on your choice of services, your Medical Procedure Package price will include the costs of selection of one, more or all of the following:
a) Healthcare service / medical procedure / surgery,
b) Accommodation,
c) Private transfers,
d) Host,
e) Any basic pre-operative tests you are advised to take upon your initial consultation.
You will be separately charged for any additional tests considered necessary other than basic pre-operative tests because of a pre-existing condition or your exposure or vulnerability to any condition, and any unanticipated cost that are unrelated to the desired procedure, complications that are unrelated and/or not detected prior to the procedure. Your Medical Procedure Package may include stay at the hospital whenever required and specifically addressed in your package. In cases where you stay more than specified, additional nights will be charged to you at the current rates of the hospital or clinic. These charges would be in addition to the total cost of the Medical Procedure Package indicated in the initial price quotation.
Once you have accepted the price quote provided to you for the treatment you choose with a link to these T&C, also meaning that you accept the T&C in this Agreement, you will be required to make an advance deposit payment to us via credit card, debit card or bank transfer. Your advance deposit is non-refundable as it constitutes only a small portion of the total package price. The remainder of your balance, being the Medical Procedure Package price minus the advance deposit, must be paid prior to your departure from your home country. Obtaining the full payment does not hold us liable for the services provided by the Medical Procedure Provider.
Non-payment of the full Medical Procedure Package price, prior to your departure from your home country, will be regarded as a breach of this Agreement and Medilab Estetik will not be bound to commit to deliver any services to you.
5. Your Medical Background and Records
Prior to your journey begins, we must obtain and submit details of your medical background to your chosen Medical Procedure Provider in Turkey, for the purposes of pre operation consultation and ensuring for the planned surgery. By accepting these T&C, you agree to allow us to share the details of your medical history, including your pictures, videos, medical images, test results, prescriptions etc, with your Medical Procedure Provider. We will not be held liable if your medical history form has not been completed thoroughly, honestly, accurately or if any information is not shared.
By accepting these T&C, you also allow us to receive your patient file made up of your consultation, examination, medical procedure plan, tests and after procedure results along with before and after pictures, videos, medical images etc. from the Medical Procedure Provider for our records. You can rest assured that we will not sell or otherwise transfer or share your personal information to any third party for any purpose other than to provide the services you request.
6. Cancellations
Upon your written notification, you may cancel your booking at any time. The cancellation will apply from the day on which we receive your written notification. The extent of charges payable will depend upon when the notification of cancellation is received. However, the cancellation charge will always be limited to actual expenses incurred and disbursements made to date, reserving the provisions set out in the article 3. In the event of a cancellation, your advance deposit will be retained as a reservation and arrangement fee.
7. Complaint
Our priority is to offer our services with high quality and to meet related healthcare expectations of our patients in the best way, within a transparent, lawful and fair communication and service approach. 8. Data Protection
Our services will include handling your sensitive personal information, including your medical records, in the strictest of confidence in secured electronic files. We will only use and share with Medical Procedure Provider your such personal information, data or records only for the purposes of your medical procedure and treatment. We will not disclose your information, data or records to any other third parties without your consent, except as is necessary for the performance of this Agreement or the enforcement by law.
9. Privacy Statement
Medilab Estetik may request to take testimonials, before the procedure and after the procedure photos and videos and for the purposes of solely marketing, training, research, analysis and health care purposes, improve Medilab Estetik site, operate your transactions and procedures, improve our services and technologies and display content for only patient preferences and interests, by complying with the protection of the personal data requirements. By accepting these T&C, you also give consent to probable use of these. To ensure your privacy, Medilab Estetik maintains all patient information in compliance with Turkish laws regarding the release and disclosure of personal health information. The before the procedure and after the procedure pictures of you can be used for demonstrative purposes and might be presented only to show possible results from various procedures. We hereby declare that images of patients will not be refined, amended or amplified in anyway to change the appearance of procedure or treatment. We will not sell or rent your personal information to third parties.
10. Applicable Laws
This Agreement is governed by the laws of England and Wales, and is subject to the jurisdiction of the courts of England and Wales.
